THE TROUBLE OF TREBIÑU AND THE OUTDATED SPANISH NATIONALISM

Abstract:

Jesus Perez de Viñaspre exposes in this article the trouble of Trebiñu: although the majority of its inhabitants want the administrative integration of the territory in the Basque Country (as it was proved in the referendum of 1998), the authorities of Castile have always opposed it.

The author stresses that democracy is not only based on compliance with the laws, but also on adapting the political reality to the democratic will of its citizens. The Treviño matter confronts the principle of legality with the democratic principle. In Europe, territorial conflicts are resolved by seeking a meeting point between the two principles In Spain, on the other hand, the principle of legality always prevails.
